This Agreement is made between My BlueZoneLife ("myBZL", "we", "us", "our"), a company registered in England and Wales, and you, the user or client ("you", "your"). These Terms govern your access to and use of our website, mobile application, data storage platform, and all related services, including educational content, data tools, and coaching services (collectively, the "Services").
1. Scope and Application
1.1 By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use or access our Services. These Terms apply to all users, regardless of their subscription plan (DIY, Mentor, or Concierge).
2. Medical Disclaimer
2.1 Not Medical Advice. You acknowledge and agree that myBZL provides general health and wellness information for educational and informational purposes only. Our Services, including all content, articles, guides, protocols, courses, and coaching provided by our staff, do not constitute medical advice, diagnosis, or treatment.
2.2 Consultation with a Professional. You must consult with a qualified healthcare professional, such as a general practitioner (GP), before beginning any health or fitness program, making any changes to your diet, or if you have any medical concerns. You agree not to disregard or delay seeking professional medical advice based on any information obtained from our Services.
2.3 No Doctor-Patient Relationship. The use of our Services does not create a doctor-patient, therapist-patient, or any other professional healthcare relationship between you and myBZL or our employees, agents, or affiliates.
2.4 No Diagnosis or Treatment. Our Services are not a substitute for professional medical care and are not intended to cure, treat, diagnose, or mitigate any disease or medical condition.
3. Limitation of Liability
3.1 General Limitation. To the fullest extent permitted by law, myBZL, its employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, exemplary, or consequential damages, including but not limited to loss of profits, data, or business, arising out of or in connection with your use of our Services.
3.2 Health and Safety. We shall not be liable for any personal injury, illness, or death resulting from your use of our Services, including any training, nutrition, or lifestyle plans. You assume full responsibility for any risks, injuries, or adverse outcomes related to your health decisions.
3.3 “As Is” Basis. The Services are provided on an "as is" and "as available" basis, without any warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. We do not warrant that the Services will be uninterrupted, error-free, or free from viruses.
3.4 Maximum Aggregate Liability. In no event shall our total aggregate liability for all claims related to the Services exceed the amount paid by you to us in the six (6) months preceding the claim.
4. User Responsibilities
4.1 Accurate Information. You warrant that all information you provide to us, including health-related data, is accurate, complete, and truthful. You are responsible for updating your information as needed.
4.2 Health Decisions. You are solely responsible for all health decisions and actions you take based on information from our Services. You must use your own judgment and consult a healthcare professional.
4.3 Medical Clearance. You represent and warrant that you are medically cleared by a qualified healthcare professional to engage in any physical exercise program or dietary changes before starting any program provided through our Services.
4.4 Responsible Use. You agree to use the Services lawfully and responsibly. You will not engage in any prohibited conduct, including but not limited to transmitting harmful code, interfering with the Service's operation, or abusing our staff.
5. Coaching Service Terms
5.1 DIY Plan (Lifetime Membership). This plan provides lifetime access to our digital content library, educational articles, templates, and data storage tools. This plan does not include any one-on-one coaching, direct human interaction, or personalised support.
5.2 Mentor Plan (£50/month). This plan includes all DIY features plus dedicated coaching services. The coach will provide general guidance for training and nutrition plans and offer accountability. The coach’s role is to motivate and guide, not to provide medical advice, diagnosis, or treatment.
5.3 Concierge Plan (£1000/month). This plan includes all Mentor features plus enhanced, in-person concierge services such as guided sessions, meal prep, and gym setup support. All in-person services are for instructional purposes only and do not create a professional healthcare or diagnostic relationship. MyBZL reserves the right to refuse or limit concierge services in certain locations.
6. Payments and Subscriptions
6.1 Fees and Payments. You agree to pay all fees and charges for the Services you select. Payments are due at the time of purchase or renewal.
6.2 Subscription Renewals. Subscriptions automatically renew at the end of each billing period unless you cancel your subscription beforehand. You authorise us to charge your payment method for the renewed subscription term.
6.3 Cancellations and Refunds. You may cancel your subscription at any time. Except as required by law, we do not provide refunds for any part of a subscription period already paid. Your access to the Services will continue until the end of the current billing cycle.
7. Intellectual Property
7.1 All content, trademarks, logos, and materials provided on our platform, including educational content, coaching plans, templates, and branding (the "Intellectual Property"), are the exclusive property of myBZL or its licensors.
7.2 You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use only. You may not reproduce, modify, distribute, or create derivative works from our Intellectual Property without our express written consent.
8. Data Protection and Privacy
8.1 GDPR Compliance. We are committed to protecting your personal data in compliance with the UK General Data Protection Regulation (GDPR).
8.2 Consent to Processing. By using our Services and submitting your health-related data (including biomarkers, wearable integrations, and lifestyle tracking), you explicitly consent to the collection, processing, and storage of this data by myBZL for the purposes of providing and improving the Services. We will process your personal data as set out in our separate Privacy Policy.
8.3 Data Security. We implement reasonable technical and organisational security measures to protect your personal data. However, we cannot guarantee absolute security.
9. Termination and Suspension
9.1 We may terminate or suspend your access to the Services at any time, without prior notice, if you breach these Terms, including but not limited to non-payment of fees or misuse of the Services. Upon termination, your right to use the Services will cease immediately.
10. Jurisdiction and Governing Law
10.1 This Agreement is governed by and shall be construed in accordance with the laws of England.
10.2 You agree that the courts of England shall have exclusive jurisdiction to resolve any dispute or claim arising out of or in connection with these Terms or your use of the Services.
11. Miscellaneous Clauses
11.1 Severability. If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.
11.2 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
11.3 Waiver. Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or our right to enforce it later.
11.4 Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and myBZL regarding the Services and supersede all prior agreements and understandings.
